Terms and Conditions
Effective July 26, 2008
It is the user‘s responsibility to read the Terms and
Conditions of discovertunes. By using the Services of this website in any way,
one agrees to be bound by its Terms and Conditions.
1. Ownership
The Website is owned by Third Floor Productions, LLC. The
content and service provided on the Website, which include but are not limited
to; graphics, code, text products, software, audio, music and design, is owned
or licensed by Third Floor Productions, LLC. The musical tracks, works,
compositions and other discovertunes materials are protected by international
intellectual property law.
2. Use of Website
Music posted on discovertunes must be fully owned by the
artist. No music that is borrowed, stolen, downloaded, or even purchased from
an artist may be posted on discovertunes. Doing so violates policies put forth
by the Recording Industry Association of America (RIAA) and thus will be
banned. Only independent artists can post audio on discovertunes.
No material from the Website may be modified, copied,
reproduced, re-published, downloaded, posted, broadcasted, transmitted,
re-transmitted or distributed in any way. Any such use is strictly prohibited
and will constitute an infringement of the copyright and other intellectual
property rights of discovertunes or the owner of such materials.
3. Registration
To use any aspect of the discovertunes services, visitors may be required to
register and provide certain information. It is required to register with
discovertunes by selecting a password and User ID. Users agree to provide
discovertunes with accurate and complete registration information to the best
of their knowledge. Failure to do so is in violation of the Terms of Use, which
may result in immediate termination of ones account. It is also a violation to
provide a third party with a User ID and password with the intent to allow for
impersonation or use a third party‘s User ID and password with intent for
impersonation. It is the responsibility of the User to maintaining the
confidentiality of their password.
A User must not register or use a User ID that is deemed offensive, vulgar
or obscene by discovertunes, and discovertunes reserves the right to refuse
registration of, or cancel an account in its discretion.
Services are available only to individuals who are at least 13 years old.
Users between the ages of 13-18 years older should obtain parental consent
before registering with discovertunes.
4. User Conduct
By visiting or registering to discovertunes, you agree to
not:
- Abuse, harass, threaten,
impersonate or intimidate other discovertunes users
- Post any content that is
defamatory, obscene, pornographic, abusive, offensive, profane, or in
violation of any law or right of any third party
- Submit unwanted email to any
discovertunes Users
- Download, copy, store, edit,
change, or alter in any way any of the tracks streamed through the
Website‘s Services
- Post audio that is not
explicitly of your (the artist‘s) creation
- Use discovertunes services to
violate any laws in your jurisdiction
- Use or provide a password and
User ID to any Third Party
5. Indemnity
You agree to indemnify and hold harmless discovertunes,
including its executives, successors, subsidiaries, affiliates, and partners
against all claims, damages, costs (including attorney‘s fees and costs) or
other expenses which arise directly or indirectly from your, or any third party
using your User ID, unauthorized use of the Website, Service or any other
materials contained on the Website.
6. Privacy
Discovertunes takes visitor privacy very seriously, however
there may be unique instances in which it is necessary for discovertunes to
disclose personal information to certain authorities. As such, it is very
important to read and understand the discovertunes privacy policy which
outlines and explains how discovertunes secures personal information.
7. Termination
Discovertunes may terminate any member‘s account immediately
without prior notice or if any of the terms or conditions of the Terms of Use
are breached. Upon termination of your account, your right to use the Services
will immediately cease.
A member may terminate their discovertunes account at
anytime.
8. Third Party
Third parties may provide links to other Sites or resources.
Because discovertunes has no control over such sites and resources, you
acknowledge and agree that discovertunes does not endorse and is not
responsible or liable for any content, advertising, products or other materials
on or available from such sites or resources. You further acknowledge and agree
that discovertunes is not responsible or liable, directly or indirectly, for
any damage or loss caused or alleged to be caused by or in connection with use
of any Third Party content, goods, or services.
9. Modifications
Discovertunes reserves the right to change, modify, and
update these Terms when it is deemed appropriate. Users will be notified about
such changes however it is the user‘s responsibility to review these Terms and
Conditions.
